Universalization Program for Basic Sanitation of
the Paraopeba Basin.

To join the Paraopeba Sanitation Program, the municipality will need to:

  • Return the signed transfer agreements to BDMG within 30 days after receiving them from the Bank;
  • Register with BDMG Digital;
  • Establish the Program Management.

The submission of projects is conditional upon joining the Program.

Funds can be allocated for the following purposes:

  1. Sanitary sewage systems,
  2. Water supply systems,
  3. Urban macro-drainage (limited to 25% of the resources),
  4. Solid waste collection, disposal, and treatment (exclusive to Brumadinho).

Important:

  • Projects must be included in the Municipal Basic Sanitation Plan (PMSB).
  • The review or development of the PMSB may be supported with Program resources.
  • The municipality may use Technical Support in all stages of the Program.
  • The deadline for project approval is 07/15/2026.
  • Funds cannot be allocated for direct execution of the works.
  • The works must be carried out on land owned by the municipality.
  • The municipality may use Program resources to regularize land where the Program works will be executed.
  • Resources may be obtained for new paving or reconstruction related to the functionality of the work, limited to 10% of its value.
  • The purchase of vans, motorcycles, agricultural machinery, or used equipment is not allowed.

The municipality that has entered into the transfer agreement with BDMG must submit the project to be executed to the Bank.

Acquisition of Machinery and Equipment​

Funds can be allocated for the acquisition of machinery, equipment, and vehicles, provided they are connected to the purpose of the Program and complement or enhance the functionality of the implemented sanitation systems.

At this stage, municipalities must specify the assets to be acquired, accompanied by a justification for their acquisition, as well as the investment value, via BDMG Digital.

After verification and approval of the submitted information, BDMG will issue the Authorization to Begin Works.

Studies, Plans, and Development of Engineering Projects​

Funds can be allocated for the preparation or review of the PMSB (Municipal Basic Sanitation Plan), PRAD (Degraded Area Recovery Plan – only for Brumadinho), and the development of engineering projects.

At this stage, municipalities must specify the intended use of the funds, accompanied by a justification and the investment amount, via BDMG Digital.

After verification and approval of the submitted information, BDMG will issue the Authorization to Begin Works.

Land Acquisition​

Funds can be allocated for the acquisition of land and/or compensation for easement strips where works related to the Program’s objectives will be executed.

At this stage, municipalities must specify the land and/or easement strips, as well as the investment amount, via BDMG Digital.

After verification and approval of the submitted information, BDMG will issue the Authorization to Begin Works.

The bidding process must only be conducted after the issuance of the bidding authorization sent by BDMG.

It is the sole responsibility of the Municipality to comply with the applicable legislation and ensure the regularity of the bidding and contracting procedure. BDMG shall not bear any responsibility for this process under any circumstances.

The bidding must comply with the requirements of Law No. 14.133/2021 (or Law No. 13.306/2016, in the case of a public company).

Land Acquisition

For land acquisition, the client must submit the documentation listed below via BDMG Digital.

  1. Conventional Purchase and Sale:
    • Land appraisal report prepared by a qualified professional.
    • Declaration of compliance with Law 8.666 or 14.133.
    • Approval and awarding term, in case of a bidding process.
    • Justification for exemption/inexigibility of bidding, if applicable.
    • Publication of the ratification of exemption or inexigibility, in cases of exemption and inexigibility of bidding.
    • Proof of partial payment of the property’s value and/or indication of the corresponding budgetary allocation.
  2. Expropriation with Agreement between the Parties:
    • Land appraisal report prepared by a qualified professional.
    • Municipal decree, municipal law, or other normative act declaring the area of public utility.
    • Proof of partial payment of compensation (with public budget resources) and/or indication of the law or budgetary allocation corresponding to the payment to be made.
    • Public deed of the property, private expropriation agreement, or property certificate with updated registration (issued within the last 30 days, to confirm the compensation beneficiary).
  3. Expropriation with Agreement between the Parties – Easement Strips:
    • Municipal decree, municipal law, or other normative act declaring the area of public utility.
    • Executed public deed, expropriation agreement, or property certificate with updated registration (issued within the last 30 days).
    • Proof of partial payment of compensation (with public budget resources) and/or indication of the law or budgetary allocation corresponding to the payment to be made.
  4. Judicial Expropriation – Land:
    • Land appraisal report prepared by a qualified professional.
    • Municipal decree or municipal law, or other normative act declaring the area of public utility.
    • Declaration of acknowledgment by the municipality that all responsibilities determined in the final judgment are the proponent’s responsibility.
    • Property certificate with updated registration (to confirm the compensation beneficiary).
    • Proof of court deposit of the determined amount.
  5. Judicial Expropriation – Easement Strip:
    • Municipal decree or municipal law, or other normative act declaring the area of public utility.
    • Public deed of the property.
    • Appraisal report of the property and the easement to be established, prepared based on ABNT 14.653.
    • Declaration of acknowledgment by the municipality that all responsibilities determined in the final judgment are its responsibility.

Attention! BDMG does not provide reimbursements. 

To receive the funds, the client must also ensure:

✓ That formal authorization from BDMG has been granted for the issuance of the service order

✓ Accountability for previously released funds, if applicable

✓ The absence of technical and/or economic-financial issues that, at BDMG’s discretion, may compromise the execution of the supported project, thereby altering or preventing its implementation

✓ The regular progress of the project, in accordance with the schedule submitted to BDMG.

Studies, Plans, and Development of Engineering Projects

PGIRS

  • Diagnosis of the solid waste situation in the respective territory, including origin, volume, characterization of waste, and methods of disposal and final destination.
  • Identification of suitable areas for environmentally appropriate final disposal of waste, in compliance with the master plan described in §1º of art. 182 of the Federal Constitution and environmental zoning, if any.
  • Identification of possibilities for implementing consortium or shared solutions with other municipalities, considering economic scale criteria, proximity of established locations, and prevention of environmental risks.
  • Identification of solid waste and generators subject to specific management plans under art. 20 or reverse logistics systems under art. 33, complying with this law, its regulations, and standards set by SISNAMA and SNVS bodies.
  • Operational procedures and minimum specifications for public urban cleaning and solid waste management services, including appropriate final waste disposal, in accordance with Law nº 11.445, 2007.

No. The Program funds are compensatory and result from a Judicial Agreement; therefore, authorization from the legislative council is not required for signing.

Yes. The Paraopeba Sanitation Program was created as compensation for the damages caused by the collapse of the Córrego do Feijão dams in Brumadinho and ensures that affected municipalities are entitled to receive funds, provided they meet the conditions outlined in the Notice.

Receiving these funds does not affect the municipalities’ debt level or financial commitments with the Bank or within the financial system.

The Program’s funds originate from the Judicial Agreement regarding known environmental damages to the Paraopeba River, caused by the collapse of the Córrego do Feijão dams in Brumadinho.

A total of R$ 1.47 billion has been allocated for the universalization of basic sanitation in the 26 affected municipalities.

Yes, provided the paving is related to the sanitation project and ensures the functionality of the work approved by BDMG. Additionally, spending on this item is limited to 10% of the total amount to be invested. Any excess amount must be covered with the Municipality’s own funds.

Items not related to the objectives of the PROGRAM, as determined by the FINANCIAL AGENT, as well as the following, will not be supported:

  • Vans

Yes, provided they are authorized by the municipality. The authorization must specify which projects will be executed and the maximum amount that can be transferred to the concessionaire.

The projects must be completed and the funds disbursed to the municipalities within 60 months, starting from 16/07/2024.

For the funds to be used within this period, the projects must be approved by BDMG by 15/07/2026.

If the municipality does not use the available funds within the stipulated deadline, the funds will be redistributed among the other municipalities covered by the Program. The redistribution criteria will be defined by the parties of the Agreement that originated the Program, prioritizing the indices and deficits of sanitation services, as per the criteria established in Law 14.026/2020.

If the funds are used by the municipality for purposes other than those outlined in the Program, BDMG will notify the State Secretariat for the Environment and Sustainable Development (SEMAD) about possible misapplications.

If technical non-compliance is confirmed, the following measures will be applied:

  1. Cancellation of the remaining balance to be released;
  2. Return of already released funds;
  3. Application of legal penalties;
  4. Other penalties that may be determined by the Parties involved in the Agreement.

It is specialized consulting to support the municipality’s team in all stages and procedures necessary for the execution of the Program.

No. All activities performed by Technical Support are funded with resources from the Agreement. These are additional resources to those each municipality is entitled to.

BDMG is responsible for managing Technical Support, including personnel allocation, quality verification, and payment for the services provided.
